In the event that you familiarize yourself with the official public offer (offer), it is considered that you fully and unconditionally agree to all the terms of the Public Offer Agreement set out below in full and unconditionally accept it (including agreeing to fulfill all obligations imposed on you by the Agreement public offer and you understand all its provisions.

The public offer contract contains the offer of the "UKRAINE ABOVE ALL" Charitable Fund in accordance with the following conditions:

1. Definition of terms

The Internet site is a site located at the address: https://ukrainaponaduse.com/, which is used by the "UKRAINE ABOVE ALL" Charitable Foundation for the purpose of carrying out charitable activities.

Fund - Charity fund "UKRAINE ABOVE ALL" is registered in accordance with the legislation of Ukraine as a non-profit organization and is located at the address: prov. Zemlyanskyi, b.3, Kyiv, 01104, identification code of the legal entity: 44701430, the sole founder of the fund is the individual Nersesyan Yevheniya Yuriyivna.

The purpose of the fund is not to receive and distribute profits among the founders, members of management bodies, other persons related to them, as well as among the employees of the fund.

The fund has transparent financial reporting. Every donation and purchase can be tracked in real time.
Offer - Public offer contract with the Fund's offer posted on the website https://ukrainaponaduse.com/ about the conditions for providing charitable assistance, about the rules for using the site, etc. The offer is aimed at an undefined circle of people.

Acceptance - full and unconditional acceptance of the Offer with the conditions and rules included in it, by taking actions aimed at using the website https://ukrainaponaduse.com/, registration, making a monetary transfer of charitable assistance to the Fund's account, other actual actions of a person on the website https ://ukrainaponaduse.com/

Charitable assistance is a free transfer of funds by the Benefactor to the property of the Foundation for further use and achievement of the Foundation's goals, defined by the Statute, charitable programs and decisions of the Foundation's management body in accordance with the Law of Ukraine "On Charitable Activities and Charitable Organizations".

A benefactor is an able-bodied individual or a legal entity under private law (including a charitable organization) who voluntarily carries out one or more types of charitable activities and has accepted this Offer.

Rules – rules of the site, which establish the principles and conditions of the site's operation and its use, the rights and obligations of users, as well as the rights and obligations of the Foundation and other persons.

The user is a natural or legal person, as well as an organization that is not a legal person, but in any way, defined and/or not defined by the Offer, uses the website https://ukrainaponaduse.com/

Beneficiary – recipient of charitable assistance (individual, non-profit organization or territorial community) receiving assistance from benefactors using the website https://ukrainaponaduse.com/ to achieve the goals defined by the Law of Ukraine "On Charitable Activities and Charitable Organizations". Beneficiaries can also be any legal entities that receive assistance to achieve the goals defined by the above-mentioned law.

Donation - the amount of charitable assistance, which constitutes a donation within the meaning of the provisions of the Civil Code, which the Benefactor provides to the Foundation for carrying out charitable activities.

Collection - an action that the Fund announces on the website https://ukrainaponaduse.com/, which consists in collecting funds to achieve a certain goal, or for the statutory goals of the Fund in a broad sense.

2. General provisions

The Foundation's website is the property of the sole founder of the "UKRAINE ABOVE ALL" Charitable Foundation, Yevgenia Yuriivna Nersesyan, and is used by the Foundation to carry out charitable activities.

The Foundation provides an email address: moc.esudanopaniarku%40ofnI - which is intended for communication, sending questions, suggestions, comments and important information.

Each person (user, benefactor, beneficiary) is obliged to read the Offer and agree with its content before using the website https://ukrainaponaduse.com/

Regardless of the actual familiarization with the presented text, if you:

- transfer charitable assistance on the website https://ukrainaponaduse.com/;
- you apply with a request (application) for the provision of charitable assistance;
- fill out any forms, register, use information and materials from the website https://ukrainaponaduse.com/, etc., then

In any case, you are considered to have familiarized yourself with the text of this Offer and unconditionally accepted it - accepted its terms.
3. Acceptance of the Benefactor

By accepting the Offer, the Benefactor indicates that he agrees with all the terms of the Offer, understands and agrees that the Charitable Assistance will be used to achieve the goals stipulated in the Foundation's Charter, which he can familiarize himself with by sending a request to the Foundation's email address .moc.esudanopaniarku%40ofni

By accepting the Offer, the Benefactor is fully aware of and agrees with the subject of the Public Offer Agreement, the goals and purpose of public fundraising, and also confirms the right of the Foundation to use a part of the Charitable Assistance for the Foundation's administrative expenses in the amount provided for by the Law of Ukraine "On Charitable Activities and Charitable Organizations".

The parties agree that from the moment of acceptance of the Offer, this Public Offer Agreement is concluded in writing in accordance with Articles 207, 639, 641 and 642 of the Civil Code of Ukraine and Articles 6 and 7 of the Law of Ukraine "On Charitable Activities and Charitable Organizations". At the same time, the parties agree that after the Acceptance of the Offer, failure to conclude this Agreement in the form of a separate document does not entail the invalidity of this Agreement.

4. Rights and obligations of the Fund

The fund has the right to:

- receive Charitable Assistance and use it in accordance with the terms of the Offer and its statutory activity; independently determine the spheres, types, place (territory), terms and beneficiaries of charitable assistance and change them as necessary, within the framework of the implementation of charitable activities provided for in the Charter, charitable programs or decisions of the Fund's management bodies;
- to use part of the Charitable Assistance for administrative expenses of the Fund in an amount not greater than that provided for by the Law of Ukraine "On Charitable Activities and Charitable Organizations";
- The Fund has the right to include in the reporting information about the identity of the benefactors or beneficiaries or their successors or legal representatives who, by accepting the Offer, give their consent to this, unless otherwise specified by law.
The fund is obliged to:
- publish at least once a year on the website https://ukrainaponaduse.com/ a report on the sources of fundraising (property) for charitable activities and the directions of their use, in accordance with the requirements of the law;
- use charitable assistance exclusively to achieve the goals stipulated by the Foundation's Charter, charitable programs, decisions of the Foundation's management bodies;
- bear responsibility for violation of the terms of this Offer in accordance with Ukrainian legislation.

5. Benefactor's rights

The benefactor has the right:

- control the use of Charitable Aid by the Fund for its intended purpose by reviewing the Fund's published report on the sources of funds (property) for charitable activities and the directions of their use;
- other rights stipulated by the legislation of Ukraine.

The benefactor is obliged to:

- use the website https://ukrainaponaduse.com/ in compliance with the terms of the Offer, the rules for using the site and the current legislation of Ukraine;
- independently bear all risks and responsibility for not familiarizing yourself with the text of the terms and conditions of the site, Offers.

6. Place of public fundraising

Public collection of charity funds is carried out all over the world. The activities of the Fund, which are related to the achievement of the goals stipulated by the Charter of the Fund, are carried out on the territory of Ukraine.


7. Terms

The public collection of funds continues until the moment of its termination according to the decision of the Foundation, about which Benefactors will be notified by placing relevant information on the website https://ukrainaponaduse.com/

8. Procedure for using Charitable Assistance

Charitable assistance is used in accordance with the goals defined by the Foundation's Charter, charitable programs and the current legislation of Ukraine, in particular the Law of Ukraine "On Charitable Activities and Charitable Organizations". Charitable assistance received by the Foundation may be returned to the Benefactor only in the cases provided for by the legislation of Ukraine and this Agreement.

The Foundation is responsible for the violation of the terms of this Offer and the use of Charitable Assistance contrary to the procedure provided for by the Foundation's statutory activities and legislation.

The Benefactor confirms his full and unconditional agreement (acceptance) with the fact that by providing charitable assistance, the Benefactor has the right to control its use in accordance with the purpose established when transferring money with the intended purpose of payment, however, if the use of charitable assistance for the intended purpose turned out to be impossible or ineffective ( for example, the need to collect charitable assistance has disappeared; the achievement of the set goal has become impossible; violations on the part of the beneficiaries have been detected; in case of cancellation of the treatment of the beneficiary; death of the beneficiary; excessive amount of fundraising for a specific beneficiary or project, etc.), using it for another purpose completely or partially, the Benefactor allows the "UKRAINE ABOVE ALL" Charitable Foundation, including for its statutory purposes.

9. Procedure for general access to information

Information on the structure and size of the Fund's income and expenses, as well as the conditions for using its assets for charitable activities, is not confidential information or a trade secret.

The person gives his consent to the fact that after entering information about himself on the website of the Foundation https://ukrainaponaduse.com/ and registering on the website, his contact information can be used by the Foundation to send letters and messages, including in electronic form. At the same time, the Fund has the right to transfer such personal data to third parties as necessary, caused by the implementation of the Law of Ukraine "On the Protection of Personal Data".

The person gives his consent that information about him (in particular, surname, first name, patronymic) may be used (exceptionally with his additional consent) by the Foundation in mass media or on the Foundation's website https://ukrainaponaduse.com/

By accepting the Offer, the person (benefactor, user, beneficiary) confirms that he gives his consent to the collection, processing and use of personal data for carrying out charitable activities and reporting to the Fund in accordance with the terms of the Offer and the legislation of Ukraine.
